1. Introducción

FieldSub, Inc., a Delaware corporation ("Company," "we," "us," or "our"), operates the FieldSub platform, including the FieldSub mobile application, web application, and any associated services, features, content, and tools (collectively, the "Service" or "Platform"). This Privacy Policy describes how we collect, use, disclose, store, and protect your information when you access or use our Service.

By accessing or using FieldSub, you acknowledge that you have read, understood, and agree to be bound by this Privacy Policy. If you do not agree to this Privacy Policy, you must not access or use the Service.

This Privacy Policy applies to all users of the Service, including but not limited to subcontractors, general contractors, employees, crew members, clients, and any other individuals who interact with the Platform.

We collect information in several ways when you use our Service. The categories of information we collect include the following:

  • Account Information: When you register for an account, we collect your name, email address, phone number, company name, business address, job title, preferred language, and login credentials.
  • Business Information: Information about your business operations, including subcontracting specialties, service areas, licensing information, insurance details, crew size, and fleet information.
  • Client Information: Information about your clients that you enter into the Platform, including client names, contact information, addresses, project details, and communication history.
  • Financial Information: Billing information, bank account details, payment method information, invoicing data, expense records, project cost estimates, profit and loss information, and transaction history processed through the Platform.
  • Project and Job Data: Project descriptions, job schedules, task assignments, crew allocations, materials lists, work orders, change orders, site addresses, floor plans, photographs, and completion records.
  • Employee and Crew Data: Information about employees and crew members, including names, contact information, certifications, work schedules, time tracking data, and assigned equipment.
  • Tool and Equipment Data: Information about tools and equipment, including descriptions, serial numbers, QR/barcode identifiers, photographs, check-in/check-out records, location data, and maintenance history.
  • Communications: Messages, voice notes, support requests, feedback, and any other communications you send to us or transmit through the Platform.
  • User-Generated Content: Photographs, documents, notes, estimates, invoices, and any other content you upload to or create within the Platform.

2.2 Información Recopilada Automáticamente

  • Usage Data: Information about how you interact with the Service, including features used, pages viewed, actions taken, frequency and duration of activities, search queries, and click patterns.
  • Device Information: Device type, operating system, browser type, unique device identifiers, mobile network information, screen resolution, and language settings.
  • Location Information: With your consent, we may collect precise geolocation data from your mobile device. We also collect approximate location information from IP addresses. Location data is used for features such as crew tracking, tool location updates, job site verification, and fleet management.
  • Log Data: Server logs that record your IP address, access times, pages viewed, app crashes, and other system activity.
  • Cookies and Tracking Technologies: We use cookies, web beacons, pixels, and similar technologies to collect information about your browsing behavior, preferences, and device information. See Section 9 (Cookies and Tracking Technologies) for more details.

  • To develop new products, services, features, and functionality.
  • To conduct research and analysis to better understand user needs, behaviors, and preferences.
  • To train and improve our artificial intelligence and machine learning models, including but not limited to our auto-estimating, tool identification, voice command, and language translation features.

3.2 Comunicaciones y Marketing

  • Service Communications: To send you service-related notices, updates, security alerts, and administrative messages.
  • Marketing Communications: To send you promotional materials, newsletters, product announcements, special offers, and information about features, products, or services that we believe may be of interest to you. You may opt out of marketing communications at any time (see Section 10).
  • Surveys and Feedback: To request your participation in surveys, research studies, or feedback programs to improve our Service.
  • Testimonials and Case Studies: With your consent, to use your name, company name, and feedback in testimonials, case studies, and marketing materials.

  • To analyze usage trends, track feature adoption, and measure the effectiveness of our Service.
  • To personalize your experience, including by presenting content and features tailored to your preferences and usage patterns.

  • To generate industry insights and reports using aggregated, non-identifiable data.

  • To respond to lawful requests from public and governmental authorities.

4. Cómo Compartimos su Información

We may share your information with the following categories of recipients:

4.1 Proveedores de Servicios

We share information with third-party service providers who perform services on our behalf, including cloud hosting and infrastructure providers, payment processors and financial service providers, analytics and data processing services, customer support tools, email and communication service providers, artificial intelligence and machine learning service providers, GPS and mapping service providers, and marketing and advertising platforms. These service providers are contractually obligated to use your information only as necessary to provide services to us and in accordance with this Privacy Policy.

4.2 Socios Comerciales

We may share information with business partners, including home improvement retailers, material suppliers, and industry associations, for purposes of facilitating referrals, partnerships, and service integrations.

We may share your information when you direct us to do so, such as when you choose to share project information with clients, general contractors, or other subcontractors through the Platform.

We may share aggregated, de-identified, or anonymized data that cannot reasonably be used to identify you for any purpose, including research, analytics, marketing, and industry benchmarking. This data may be shared with third parties, partners, and the public.

We may disclose your information if we believe in good faith that disclosure is necessary to comply with applicable law, regulation, or legal process; respond to a valid subpoena, court order, or government request; protect the safety, rights, or property of FieldSub, our users, or the public; detect, prevent, or address fraud, security, or technical issues; or enforce our Terms of Use or other agreements.

4.6 Transferencias Comerciales

In connection with any merger, acquisition, reorganization, sale of assets, financing, or transfer of all or a portion of our business, your information may be transferred to the acquiring entity. We will notify you via email and/or a prominent notice on the Service of any change in ownership or uses of your information.

5. Retención de Datos

We retain your information for as long as your account is active or as needed to provide you with the Service. We may also retain and use your information as necessary to comply with our legal obligations, resolve disputes, enforce our agreements, and for legitimate business purposes such as analytics and recordkeeping.

When you delete your account, we will initiate the deletion of your personal information within thirty (30) days, except where we are required or permitted by law to retain it or where retention is necessary for our legitimate business interests. Aggregated or de-identified data derived from your information may be retained indefinitely.

Business records, including financial transaction data, invoices, and payment records, may be retained for up to seven (7) years after account termination to comply with tax, accounting, and regulatory requirements.

We implement commercially reasonable administrative, technical, and physical security measures designed to protect your information from unauthorized access, disclosure, alteration, and destruction. These measures include:

  • Encryption of data in transit using TLS/SSL protocols.

  • Access controls and authentication mechanisms.
  • Employee security training and confidentiality agreements.
  • Incident response procedures.

However, no method of transmission over the internet or method of electronic storage is 100% secure. While we strive to use commercially reasonable means to protect your information, we cannot guarantee its absolute security. You acknowledge and agree that you transmit your information at your own risk and that we are not responsible for any circumvention of privacy settings or security measures contained on or within the Service.

In the event of a data breach that compromises your personal information, we will notify you in accordance with applicable law and take reasonable steps to mitigate any harm. Our liability in connection with any data breach shall be limited as set forth in our Terms of Use.

7. Inteligencia Artificial y Procesamiento Automatizado

FieldSub uses artificial intelligence ("AI") and machine learning technologies to power various features of the Service, including but not limited to:

  • Auto-estimating and cost estimation from project descriptions and floor plans.
  • Tool identification and inventory management via image recognition.
  • Voice command processing and natural language understanding.
  • Language translation between English and Spanish (and potentially other languages).
  • Smart scheduling and resource allocation suggestions.
  • Predictive analytics for project planning and business insights.

By using the Service, you consent to the processing of your data by our AI systems. You acknowledge that:

  • AI-generated outputs, including estimates, translations, and suggestions, are provided as aids and are not guaranteed to be accurate, complete, or error-free.
  • You are solely responsible for reviewing and verifying any AI-generated output before relying on it for business decisions.
  • We may use your data, including project data, estimates, and user interactions, to train and improve our AI models, subject to appropriate de-identification and aggregation measures.
  • AI processing may involve the transmission of your data to third-party AI service providers who are bound by confidentiality and data protection obligations.

8. Aviso sobre Traducción de Idiomas

FieldSub provides bilingual functionality in English and Spanish, as well as real-time language translation features. While we strive for accuracy in all translations:

  • Translations are provided "as is" without warranty of any kind, express or implied, including warranties of accuracy, completeness, or fitness for a particular purpose.
  • Automated and AI-powered translations may contain errors, inaccuracies, or omissions. Slight discrepancies between the English and Spanish versions of any content, including but not limited to estimates, invoices, contracts, project descriptions, and communications, may occur.
  • In the event of any discrepancy between the English and Spanish versions of the Terms of Use, Privacy Policy, or any other legal document, the English version shall prevail.
  • You are responsible for verifying the accuracy of any translated content, especially for legally binding documents, contracts, and financial records.
  • We shall not be liable for any losses, damages, or misunderstandings arising from translation errors or inaccuracies.

We continually work to improve our translation capabilities, and we welcome feedback regarding translation quality through our support channels.

9. Cookies y Tecnologías de Seguimiento

We use cookies and similar tracking technologies to collect and use information about you and your interactions with the Service.

10. Sus Derechos y Opciones

10.1 Acceso y Portabilidad

You may request access to the personal information we hold about you and request a copy of your data in a structured, commonly used, and machine-readable format.

10.2 Corrección

You may request that we correct any inaccurate or incomplete personal information we hold about you.

10.3 Eliminación

You may request that we delete your personal information, subject to certain exceptions as required or permitted by law.

10.4 Cancelar Suscripción de Marketing

You may opt out of receiving marketing communications from us by following the unsubscribe instructions in any marketing email, updating your communication preferences in your account settings, or contacting us directly. Please note that even if you opt out of marketing communications, we may still send you service-related communications.

10.5 Datos de Ubicación

You may disable location services through your device settings. Note that disabling location services may limit the functionality of certain features, including crew tracking and tool location updates.

10.6 No Rastrear

Some browsers transmit "Do Not Track" signals. We currently do not respond to "Do Not Track" signals, as there is no industry standard for how to handle such signals.

11. Derechos de Privacidad de California (CCPA/CPRA)

If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA):

  • Right to Know: You have the right to request information about the categories and specific pieces of personal information we have collected, the categories of sources, the business purposes for collecting the information, and the categories of third parties with whom we share it.
  • Right to Delete: You have the right to request deletion of your personal information, subject to certain exceptions.
  • Right to Correct: You have the right to request correction of inaccurate personal information.
  • Right to Opt-Out of Sale/Sharing: We do not sell your personal information. If this changes, we will provide a clear opt-out mechanism.
  • Right to Non-Discrimination: We will not discriminate against you for exercising your privacy rights.

To exercise your rights, contact us at privacy@fieldsub.com or through the contact information provided in Section 15. We will respond to verifiable requests within 45 days.

12. Privacidad de Menores

The Service is not directed to individuals under the age of 18. We do not knowingly collect personal information from children under 18. If we learn that we have collected personal information from a child under 18, we will take steps to delete such information as soon as possible. If you believe that a child under 18 has provided personal information to us, please contact us at privacy@fieldsub.com.

13. Transferencias Internacionales de Datos

Your information may be transferred to and processed in countries other than your country of residence. These countries may have data protection laws that differ from the laws of your country. By using the Service, you consent to the transfer of your information to the United States and other jurisdictions where we or our service providers operate.

We take appropriate safeguards to ensure that your information remains protected in accordance with this Privacy Policy, including the use of standard contractual clauses and other transfer mechanisms as required by applicable law.

14. Cambios a esta Política de Privacidad

We may update this Privacy Policy from time to time. When we make changes, we will update the "Last Updated" date at the top of this Policy and, where required by law, provide you with notice of the changes. For material changes, we will provide prominent notice through the Service or by sending you an email. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Privacy Policy.

We encourage you to review this Privacy Policy periodically to stay informed about how we are protecting your information.
